Kinect Privacy Policy

Your privacy is a core priority for us. This policy describes how Facility Kinetics (Kinect) collects, uses, and protects your data when you use our website, management platform, or smartphone access systems.
1. The Kinect Promise: No Data Selling
Kinect does not sell your data. We are not in the business of harvesting member info for third-party advertisers. Your data exists solely to run your gym and keep your facility secure.
2. Types of Information We Collect
We only collect what is absolutely necessary to run the facility:
- Personal Identifiers: Name, email, phone, and address for membership management
- Financial Data: Securely handled via Stripe for automated billing
- Health Info: Injury notes or medical history used by trainers for member safety
- Access Logs: Timestamps of entries and remote unlocks for safety audits
3. The Wi-Fi Rule and Location Privacy
Kinect uses presence-based access to keep facilities secure:
- Point-in-Time Verification: The app verifies your smartphone is on the facility Wi-Fi network only when you attempt to unlock a door
- No Tracking: Once the door is released, location data is discarded. Kinect does not track members outside the facility
4. Data Residency: Keeping it in Canada
For our Canadian operators, data residency is vital. Kinect stores data on secure servers within Canadian borders (specifically AWS Canada Central regions) to ensure protection under Canadian law.
5. Artificial Intelligence and Machine Learning
Kinect uses anonymized and aggregated data to train our internal AI systems, including our Master Brain and support agent, Kay.
This data is stripped of all personally identifiable information (PII) before it is processed. We use this information solely to improve facility automation and support. No individual identity is ever exposed.
6. Youth and Minor Privacy
For any member under the age of 18, we require the consent of a parent or legal guardian for data collection.
Parents or legal guardians retain the right to access the entry logs and membership data of their child until that member reaches the age of 18. Once a member turns 18, all privacy rights transition to the individual and parental access is revoked.
7. Gym Owner Specific Policies
Individual gym owners may have their own additional privacy rules, such as the use of CCTV cameras or specific on-site waivers.
These are separate from the Kinect software policy. Members should consult with their local facility owner regarding on-site surveillance or physical facility rules.
8. Security Responsibility
Security is a three-tier system:
- Infrastructure: AWS and Stripe handle physical server security and payment encryption
- Application: Kinect manages software encryption and database patching
- Operations: The Gym Owner acts as the Privacy Officer and is responsible for staff training and password hygiene
9. Data Retention and Deletion
Under PIPEDA, we only keep information as long as it is necessary for its stated purpose.
When a membership is cancelled, we follow standard protocols to ensure data is purged when it is no longer required for legal or financial records.
10. Business Transfers
If Kinect undergoes a merger or sale, member data may be transferred to the new entity.
This ensures your gym access remains uninterrupted. Any new entity must honor the promises made in this policy.
11. Your Rights
Under Canadian law, you have the right to:
- Access the personal information we hold
- Correct inaccuracies
- Withdraw consent
Note that withdrawing consent for data collection will result in a loss of gym access.
